In consideration of the benefits and privileges of participating as a volunteer at the Des Moines Arts Festival®; and exchanging mutual considerations of various types; the sufficiency of which is hereby acknowledged, volunteer hereby releases Des Moines Arts Festival directors, officers, employees, and other agents or affiliates from any and all liability for any damage or injury, including death, suffered by the volunteer, in connection with any work or other activities related to the Des Moines Arts Festival.
In consideration of the benefits and privileges of serving as a volunteer for the Des Moines Arts Festival, the sufficiency of which is hereby acknowledged, I agree to the following:
1. I do not know of any physical or mental condition which prevents me from safely performing my volunteer assignment;
2. ASSUMPTION OF THE RISK: I acknowledge and understand the risk of serious illness and death does exist by attending and/or participating in the event; I KNOWINGLY ASSUME THE RISK OF INJURY, HARM OR LOSS WHILE ACTING AS A VOLUNTEER, INCLUDING ANY INJURY, HARM OR LOSS CAUSED BY THE NEGLIGENCE OR CONDUCT ON THE PART OF THE DES MOINES ARTS FESTIVAL. This also includes all risks related to illness and infectious diseases, such as COVID-19.
3. RELEASE AND INDEMNIFICATION: I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE DES MOINES ARTS FESTIVAL AND ITS DIRECTORS, OFFICERS, EMPLOYEES AND OTHER AGENTS FROM ANY AND ALL LIABILITY FOR ANY DAMAGE OR INJURY, INCLUDING DEATH, SUFFERED BY ME IN CONNECTION WITH ATTENDING AND/OR PARTICIPATING IN THE EVENT, INCLUDING BUT NOT LIMITED TO DAMAGES OR INJURY CAUSED BY THE NEGLIGENCE OF DES MOINES ARTS FESTIVAL OR CAUSED DIRECTLY BY NEGLIGENCE OR WILLFUL MISCONDUCT OF MYSELF (VOLUNTEER). Furthermore, any damages caused by me shall be my sole responsibility and I AGREE TO INDEMNIFY, HOLD HARMLESS AND DEFEND DES MOINES ARTS FESTIVAL FROM AND AGAINST ANY AND ALL RESULTING CLAIMS, ACTIONS OR DAMAGES OF WHATERVE NATURE, WHETHER CAUSED BY OR CONTRIBUTED TO IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE DES MOINES ARTS FESTIVAL OR OTHERWISE. This release and indemnification shall be binding on my heirs, successors, and personal representatives and inures to the benefit of Des Moines Arts Festival, and its successors and assigns.
4. Electronic Signature Agreement. By selecting/checking the "I agree to the terms and conditions" and completing the Name Field and Date Field at the end of this document, volunteer is signing this Agreement electronically. Volunteer agrees their electronic signature is the legal equivalent of their manual signature on this Agreement. By selecting "I agree to the terms and conditions" Volunteer consents to be legally bound by this Agreement's terms and conditions. Volunteer further agrees that their use of a keypad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide Des Moines Arts Festival, or in accessing or making any transaction regarding any agreement, acknowledgment, consent terms, disclosures or conditions constitute their signature (hereafter referred to as "E-Signature"), acceptance and agreement as if actually signed by Volunteer in writing. Volunteer also agrees that no certification authority or other third-party verification is necessary to validate an E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of the Volunteer’s E-Signature or any resulting contract between Volunteer and Des Moines Arts Festival.
I HAVE READ THIS RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT, FULLY UNDERSTAND ITS TERMS AND AGREE TO ALL OF ITS TERMS.
